1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and SafeWork Tech Pty Ltd ("SafeWork Tech", "we", "us", or "our") concerning your access to and use of our workplace health and safety software platform and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Service Description

SafeWork Tech provides a cloud-based software platform designed to help organizations manage workplace health and safety compliance, including:

- Incident reporting

- Risk assessments

- Safety inspections

- Compliance tracking

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must create an account with accurate, complete, and current information. You may create a personal account or a team account with multiple authorized users.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. You must notify us immediately of any unauthorized access.

3.3 Age Requirement

You must be at least 18 years old to use the Service.

4. Subscription and Payment

4.1 Subscription Plans

The Service is offered on a subscription basis. Pricing details are available on our website.

4.2 Billing

- Fees are billed in advance (monthly or annually).

- All fees are in AUD and include GST where applicable.

4.3 Payment Methods

You authorize us to charge your selected payment method. Failure to pay may result in suspension or termination.

4.4 Cancellation and Refunds

- You may cancel at any time.

- Cancellation takes effect at the end of the billing period.

- No refunds for partial periods unless required by law.

5. User Content and Data

5.1 Your Data

You retain ownership of all data you upload ("User Content"). You grant us a limited license to use it to provide and improve the Service.

5.2 Data Responsibility

You are responsible for the accuracy, quality, legality, and required consents related to your data.

5.3 Data Security

We implement reasonable security measures but cannot guarantee absolute security.

5.4 Data Backup

You are responsible for maintaining your own backups.

6. Acceptable Use

You agree not to:

- Use the Service unlawfully

- Interfere with systems or networks

- Attempt unauthorized access

- Transmit malware or malicious code

- Reverse engineer the Service

- Remove proprietary notices

- Harass or harm others

- Resell or commercialize the Service without permission

7. Intellectual Property

All intellectual property in the Service belongs to SafeWork Tech or its licensors and is protected by law.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service.

9. Warranties and Disclaimers

9.1 Service Availability

We do not guarantee uninterrupted or error-free service.

The Service is provided "as is" without warranties.

9.4 Australian Consumer Law

Nothing in these Terms limits your rights under applicable law.

10. Limitation of Liability

These Terms apply while you use the Service.

- Access ceases immediately.

- Data may be deleted after termination (with export opportunity).

These Terms are governed by South Australian and Australian law.

17. General Provisions

Entire Agreement These Terms and the Privacy Policy constitute the full agreement.

Severability Invalid provisions do not affect the rest.

Waiver Failure to enforce rights does not waive them.

Assignment You may not assign rights; we may.

Force Majeure We are not liable for events beyond our control.
